Choosing the Right Lawyer for Your Case Matters.

I'm David Pelesko. I've spent nearly three decades handling personal-injury cases throughout New Jersey. I've worked inside some of the largest insurance companies in the world and for some of the best plaintiffs' law firms in the country. I've handled thousands of settlements, depositions, arbitrations and mediations.

Today, I use that experience to represent injured people. My experience on both sides of the table taught me how to evaluate cases, negotiate them intelligently, and pursue the strongest recovery possible as expeditiously as possible.

I Know How the Other Side Thinks

I don't have to guess how insurance companies evaluate cases.

I've worked for them.

Over the course of my career, I've represented defendants, employers, businesses and insurance companies. I've worked inside two of the largest insurers in the world—GEICO and Nationwide—and represented a number of other insurance carriers in private practice.

I've seen how claims are evaluated, how reserves and settlement authority are discussed, what weaknesses get attention, what evidence changes minds and makes negotiations move.

Today, I use that experience to help injured people get the most out of their cases in the least time possible.

Most Cases Settle. So Negotiation Matters.

Every personal-injury website seems to want to tell you how hard its lawyers will fight for you in court.

Sometimes a case needs a courtroom battle.

But the truth is: 98% of all personal-injury lawsuits ultimately resolve through negotiation. That makes having an experienced, skilled and prepared negotiator on your side during settlement discussions a key part of recovering the most for your case.

I've spent decades negotiating high-value settlements in matters both complex and straightforward.

My approach to litigation is not to create conflict just to look tough in front of my clients—or, worse yet, in front of my adversary.

Instead, I focus on understanding the details of the case, developing the evidence, identifying where the leverage is, and then using that leverage to pursue the best possible resolution as quickly as possible.

When a Case Can't Settle

A small percentage of cases can't be settled.

That's just reality.

I have established relationships with experienced New Jersey trial lawyers, including attorneys Certified by the Supreme Court of New Jersey as Civil Trial Attorneys, who are ready to join me when a case needs to go to court and be tried to conclusion.

The objective is simple:

Use the right lawyer for the job. Do what's best for the client.

I'm Not Going to Promise You a Fortune After a Fifteen-Minute Phone Call

Nobody knows what a personal-injury case is worth before the evidence can be reviewed.

And what I won't do is manufacture unrealistic expectations just to get a signature on a retainer.

You deserve better than that.

I'll tell you what I think. I'll tell you what concerns me. I'll tell you what's favorable. And I’ll give you my initial assessment.

From there, we'll obtain the evidence, develop the case, formulate a position and start working toward getting your case resolved.

Experience From Both Sides of the Table

I represent people injured through the negligence of others in motor-vehicle accidents, unsafe-property cases and other negligence matters.

My plaintiff, defense and insurance experience gives me an unusual perspective on how these claims are investigated, challenged, valued and negotiated.

Workers' Compensation

Civil Litigation and Workers' Comp

I've spent substantial portions of my career working in both New Jersey civil litigation and workers' compensation.

That combination matters in injury cases.

Medical evidence, causation, permanency, disability, expert opinions and settlement valuation show up in both systems—but the rules and strategy are very different.

I understand both.

Old-School Judgment. Modern Tools.

I've practiced law long enough to remember when a fax machine was considered advanced technology.

I have no particular desire to practice that way again.

I use modern legal technology—including carefully supervised AI-assisted tools where appropriate—to improve organization, analyze information, review large records and work more efficiently.

Technology doesn't replace judgment.

Experience tells me what to look for. Technology can help me find it faster.

About David Pelesko

I was born in New Jersey, did my clerkship in a New Jersey courthouse, and I've practiced law here for the past 29 years.

During that time, I've learned that litigation isn't a street fight.

The winner isn't the lawyer who talks the toughest or swaggers the most.

I know how insurance companies place a value on injuries and what evidence they need to see before those values start moving up. I know how to speak their language, how to challenge their position and how to move a case onto the front burner inside an insurance company.

I know how to move cases because I've been doing it for decades.

If you've been injured and want a straight assessment of your situation, contact me.

I'll listen to what happened, ask the questions that matter, and tell you what I think the next step should be.

I won't fill you full of hot air that sounds great today—but isn't worth anything when the case has been dragging on for years.
